Terms and Conditions

1. Acceptance of Terms and Conditions

1.1 The Ts&Cs set out the terms and conditions on which we will provide Classes to the Pupil. Please ensure that you read these Ts&Cs carefully, and check that the details on the Registration Form are complete and accurate, before you sign the Registration Form. If you have any questions about the Ts&Cs, please ask us before signing.

1.2 By signing the Registration Form, you agree to be bound by these Ts&Cs.

2. Responsibility

2.1 You confirm that you are the parent or legal guardian with responsibility for the Pupil. You agree that a Responsible Adult will attend each Class with the Pupil unless expressly agreed in advance with us on a “Class by Class” basis.

2.2 You confirm that the information set out in the Registration Form is accurate in all material respects and that you will inform us of any changes immediately.

2.3 You acknowledge that the Pupil will be under the supervision, care and control of a Responsible Adult at every Class and that the Responsible Adult will be responsible for the welfare and conduct of the Pupil whilst the Pupil is on the Training Site.

2.4 Classes will normally be held outdoors in public spaces which have been carefully selected by Little Wheelers. During the Classes the Responsible Adult shall be responsible for the whereabouts of the Pupil and shall take special care to ensure that the Pupil stays within the boundaries demarcated by Little Wheelers.

2.5 You will compensate us and keep us compensated against all loss, liability, costs and expenses which we may incur as a result of any actions of a Responsible Adult or the Pupil unless we are negligent or at fault.

2.6 We are not liable for any loss or damage to personal belongings which you bring to the Training Site, unless we are negligent or at fault.

3. Discipline and Inappropriate Behaviour

3.1 If we decide that the Pupil or Responsible Adult’s behaviour is unacceptable, we are entitled to exclude the Pupil and/or the Responsible Adult from a Class or the Training Site for any period that we may decide is appropriate. Unacceptable behaviour shall include damage to property, disruptive behaviour, any form of verbal or physical aggression towards the Instructor or other pupils, or any other behaviour as we reasonably determine.

3.2 If the Pupil or the Responsible Adult is excluded from the Class for the reasons mentioned, our liabilities to you cease to exist and Little Wheelers will be under no obligation to offer any kind of refund or compensation whatsoever.

4. Health and Safety

4.1 You must inform Little Wheelers and the Instructor of any medical condition or injuries that the Responsible Adult or the Pupil may have before the start of any Introductory Session, the Term or each Class, as applicable. If you have any health concerns which may have an effect on participation in the Classes, it is advisable that you consult your GP or health visitor before attending Classes.

4.2 It is the Responsible Adult’s sole responsibility that the Pupil is dressed appropriately for the Classes. All Pupils MUST wear an approved cycle helmet while undertaking the training.

4.3 The Instructor reserves the right at all times to decline training if the Pupil is not appropriately dressed, the Pupil’s bicycle is not roadworthy or the Pupil is unable to physically control the bicycle, or if the Instructor otherwise has a safety concern for the Pupil themselves or other pupils in the Class.

4.4 You agree that the Instructor can adjust the Pupil’s bicycle if necessary.

5. Fees and Payment

5.1 You shall pay us the Fees for a complete Term at any time before the first Class of that Term. Failure to make a full Term Fee within 7 days from the start of the Term will result in cancellation of your booking without any further notice and the Pupil will be denied access to the Class.

5.2 Confirmation of booking will only be sent by email to the email address you have notified to us on the Registration Form.

5.3 No credit shall be given for Classes which have been missed by the Pupil in exchange for future Classes.

5.4 In the event of illness of the Pupil which causes two or more classes to be missed a credit note may be issued. To obtain a credit note please contact Little Wheelers no later than the day of the Class. Little Wheelers may request a medical certificate to be produced.

5.5 Cheques which are returned by a bank as unpaid will incur an administration charge of £20.

6. Changes or Cancellation by Us

6.1 We reserve the right to cancel our agreement with you to provide the training to the Pupil at any time. In such event we will refund the Fees paid for that Term, less the cost of any Classes already attended by the Pupil.

6.2 We reserve the right to change the Instructor taking the Classes at any time.

6.3 Classes held outdoors are weather-dependent and we may cancel a Class due to bad weather on the day of the Class. A notice will be posted on our Little Wheelers Facebook page, indicating that the Class has been cancelled and it is your responsibility to check whether the Class is cancelled or not.

6.4 A permanent change in the location or time of a Class will constitute a change of these Ts&Cs and will be notified accordingly.

6.5 We may change these conditions at any time. We will endeavour to give you as much notice as possible in the event of any changes. If you do not agree to the changes, we will refund the Fees for any outstanding Classes.

6.6 We cannot accept liability or pay compensation if we are forced to cancel or in any way make changes to your Term or a Class due to any reason outside our control or any other disruptions caused by third party contractors.

7. Cancellation by You

You may cancel either before or during the Term. Where we are able to fill the space with another pupil, we will refund you any Fees paid, less the cost of any Classes already attended by the Pupil.

8. Exclusion of liability

8.1 Little Wheelers accepts responsibility to you, the Pupil or the Responsible Adult for any loss suffered by that person (however caused) where we are at fault or negligent.

8.2 Nothing in these Ts&Cs shall exclude or limit liability for Little Wheeler’s negligence or negligent omission which causes damage to the Responsible Adult or the Pupil’s property, personal injury or death to the Responsible Adult or the Pupil.

9. General

9.1 Neither Little Wheelers nor you may alter the Ts&Cs without the agreement of the other.

9.2 These Ts&Cs shall be governed by English law and shall be subject to the non-exclusive jurisdiction of the English courts.

10. Definitions

10.1 Classes means each session delivered by an Instructor at the Site, including any Introductory Session;

10.2 Fee means the price of the Classes, as applicable from time to time;

10.3 Instructor means the person employed by Little Wheels to teach the Classes;

10.4 Introductory Session means a free of charge introductory session

10.5 Little Wheelers, we or us means Little Wheelers Limited (Company Number 09582224), a company incorporated in England, having its registered office at 52 Potash Road, Billericay, Essex CM11 1DL;

10.6 Pupil means the child named on the Registration Form;

10.7 Responsible Adult means you or the person chosen by you to attend the Class with the Pupil;

10.8 Registration Form means the form for enrolling the Pupil for Classes with Little Wheelers, which you have completed and signed;

10.9 Training Site means the place where the Class takes place;

10.10 Term means a period of up to 12 weeks (as applicable), starting with the first Class of that period;

10.11 Ts&Cs means the terms and conditions set out in this document, together with the Registration Form; and

10.12 You means the parent or legal guardian who has signed the Registration Form for a Pupil and is responsible for the payment of any Fees for that Pupil and you shall be construed accordingly.

Little Wheelers offers professional cycle coaching for children aged 2-12. From balance bike level to joining their first cycling club, our aim is to help your child develop their confidence on their bike as well as teaching key bike handling skills in a safe and fun environment.
